Terms of Service

By commissioning me in any kind of way, you are agreeing to the terms of service below.
Any statement can be bound to change if discussed with the Artist, Nguyen Thi Phuong Anh prior to the commission.

I. General Terms

The Site is an e-commerce website and portfolio operated by Digital Artist Nguyen Thi Phuong Anh (Ann Nguyen). These Terms set forth the terms and conditions under which you may use the Artists' website and services provided by the Artist.

This website is the official website of Digital Artist Nguyen Thi Phuong Anh featuring digital paintings, portraits, print artworks, and other creative things. All artworks and print items listed in the Print Shop on this website, are available for visitors and/or clients to purchase online. The Artist also has social media pages such as Facebook and Instagram that visitors and clients can comment and interact with the Artist. By using or accessing the website services or online purchase, you approve that you have read and agree to be bound by these Terms.

Every user’s data and other personal information are strictly protected by Nguyen Thi Phuong Anh's Online Privacy Policy. As a user, you herein consent to the collection and use of the information provided, including the transfer of information within Singapore and/or other countries for storage, processing, or the uses by Nguyen Thi Phuong Anh.

II. Payment / Purchase Policy

All payments are made through PayPal and Stripe, the third-party payment processors. Processing payments through these platforms are subject to third parties' Terms of Service and Privacy Policy.

For direct payments via bank transfer, PayNow, PayLah, Google Pay, kindly send me the following info via email or text (Whatsapp/ Telegram/ Messenger):

  • A copy of your Prove of Purchase

  • The selected product(s), size(s), quantity

  • Your preferred collection mode (Singpost or self-collection)

  • All the details are to be sent within the next 3 days from the date of payment. Any delay in payment within the time frame will be considered a void transaction.

Upon completion of your online purchase, you will receive a confirmation email from the selected mode of payment (PayPal/Stripe), or directly from Artist for direct payments. Artist will make reasonable efforts to package the artwork and ship it within seven (7) business days. The time frame may depend on seasonal/holiday, or for unforeseeable circumstances. If Artist is unable to ship the artwork in a timely manner, she will contact the buyer via phone call, email, or text as soon as possible.

Visit the Artists' Shipping for more detailed information about her shipping and handling policies which includes damaged artwork upon shipment, as well as shipping and handling estimated pricing. At this time, Nguyen Thi Phuong Anh does not provide shipping outside of Singapore and/or Asia.

*Please note that there may be a delay in shipping overseas due to Covid-19.

III. Commission Process

The time for your commission to be completed can range from 2 weeks - 1 month, depending on the complexity of the artwork, as well as other circumstances that may affect the Artist’s process. In such cases, Artist will personally inform the Commissioner of the delay.

The Commissioner shall pay Artist the total fee indicated for the selected commission package. Payment shall be made as follows:

  • 50% as down payment after the 1st draft (line art).

  • Remaining 50% within 7 days upon finalizing the final commission.

Artist will follow up with the final packaging of the necessary documents indicated in the selected commission via email. The shared packaged folder soft copies will continue to be available for download as and when Commissioner still needed access.

Any loss of link file to the soft copies will be replaced with a new link upon request by email.

Commissioners are welcome to suggest changes to the finished commissions, such as size, color, facial tweak, layout. Any greater changes that include re-doing of the entire artwork will come with an extra charge. Commissioners are responsible for delivering a clear order when engaging the Artist for commission.

Color of artworks

You understand and agree that the Artist has made reasonable efforts in order to display the colors of the original artworks accurately on this website. Each individual monitor, cell phone, tablet, or other device may display colors differently. Nguyen Thi Phuong Anh is not responsible for the color accuracy on your computer monitor, cell phone, tablet, or other devices.

This also applies to art prints, there may be color differences between the original artwork and the fine art print. The Artist does her best to match colors accurately, but color differences within art prints versus original artwork may still exist.

IV. Copyright / Usage Policy

Content and images published on this site such as images (both pictures/photos as well as artworks), graphics, text, logos, video, and written content is the property of Nguyen Thi Phuong Anh and is adhered to the Singapore Copyright Act. The entire collection of artworks and content on this website, artaffective.com, is the exclusive property of Nguyen Thi Phuong Anh along with the copyright authorship for this compilation by Nguyen Thi Phuong Anh.

Nguyen Thi Phuong Anh, the artist, holds every right to the produced artwork, not the commissioner. Therefore, Artist is allowed to use the copyrighted artwork to promote, publish, display and/or post the artwork anywhere to her preference.

The commissioners are allowed to:

  • Use the copyrighted Artist’s artwork for personal use upon agreement.

  • Printing of the art, and claim the right of their character(s) but not the drawing itself.

  • Use the art to promote themselves with proper credit given to the Artist.

If commissioners break the copyright infringement in any way, every right you had to the drawing will be retracted.
The following is considered Copyright infringement:

  • Distribute, reproduce, or otherwise profit from the commission, beyond the resale of the original artwork.

  • Taking Credit for the creation of the artwork.

  • Edit, alter, or trace the artwork without the Artist’s permission, or as agreed upon in the Commission Agreement prior to Start of Work.

A Purchase of Commercial rights to the artwork will always be 300% of the original price.
Credit is still required for the usage of the artwork, even if altered or edited.

V. Cancellation / Refund Policy

For commission artwork:

Commissioner may terminate the commission at any time by sending written notice thereof to Artist via email. Upon such termination, Commissioner agrees to compensate Artist as follows:

  • Partial Completion. If Artist has partially completed the commission and has sent over the 1st draft for review, the Commissioner agrees to complete the 50% amount of the down payment.

  • Full Completion. If Artist has completed the finished artwork at the time of cancellation, the Commissioner agrees to compensate the selected commission package in full as otherwise provided in this Agreement.

Any statement can be bound to change if discussed with the Artist, Nguyen Thi Phuong Anh prior to the commission.

For any purchases in the shop:

All sales are final, No Refunds, No Returns. The artwork is only refunded if it is damaged during shipment. For more information on how to handle damaged artwork upon shipment, visit the Shipping page.

If there are any problems or discrepancies with your purchase or otherwise, please contact the Artist, Nguyen Thi Phuong Anh, within seven (7) calendar days of the purchase of the artwork/ commission via email tohavi.ume@gmail.com.
